Gander Service Terms and Conditions

1. Introduction

These Terms and Conditions govern your use of the Gander service, a Discord bot service provided as a free project. By using Gander, you agree to be bound by these terms.

IMPORTANT: If you are located in the United Kingdom, European Economic Area (EEA), or Switzerland, additional provisions under UK GDPR and related data protection laws apply to your use of this service. Please review Section 17 (UK and EEA Users) carefully.

2. Service Description

Gander is an AI-powered Discord bot designed to help server owners manage and grow their communities effectively through AI-driven conversations, role management, and scheduled messaging. This is a free, best-effort project provided without warranty or guaranteed availability.

AI Technology: Gander utilises third-party artificial intelligence services to generate conversational responses. The specific AI provider(s) may change at any time without notice. Currently, Gander may use:

  • Google Gemini API (provided by Google LLC)
  • Amazon Bedrock (provided by Amazon Web Services, Inc.) - for future use

You acknowledge and agree that your use of Gander is subject to the terms, conditions, and privacy policies of these third-party AI providers as outlined in Section 18.

3. Acceptable Use

You agree to use Gander in compliance with all applicable laws and Discord's Terms of Service. You will not use Gander to:

  • Harass, abuse, or harm others
  • Promote discrimination or hateful content
  • Engage in any illegal activities
  • Violate Discord's community guidelines
  • Spam or disrupt Discord server experiences
  • Generate inappropriate or harmful AI responses
  • Attempt to circumvent, manipulate, or exploit AI safety filters
  • Use the service to generate content that violates the AI provider's usage policies
  • Submit prompts designed to extract training data, model weights, or proprietary information
  • Use the AI capabilities for any medical, legal, financial, or other professional advice purposes

4. User Content

Any custom configurations, messages, or other content you create using Gander remains your responsibility. The project does not claim ownership of your content but reserves the right to remove content that violates these terms.

Important: Content you submit to Gander's AI features (including messages, prompts, and conversation context) may be processed by third-party AI providers. You warrant that you have all necessary rights and permissions to submit such content.

5. AI Content Disclaimer

Gander uses AI technology to generate responses and content. The AI responses are generated automatically and may not always be accurate, appropriate, or reflect the views of the project. Users are responsible for monitoring and moderating AI-generated content in their Discord servers.

AI Limitations:

  • AI-generated content may contain factual errors, outdated information, or hallucinations
  • The AI may produce inconsistent responses to similar queries
  • AI responses should not be relied upon for accuracy in critical decisions
  • The AI may occasionally generate inappropriate content despite safety measures
  • Response quality, tone, and accuracy are not guaranteed

No Professional Advice: AI-generated content does not constitute professional, legal, medical, financial, or any other form of expert advice. Any reliance on AI-generated content is at your own risk.

6. Data Collection and Privacy

Gander collects certain data to provide and improve the service. This includes:

  • Discord server information
  • Bot configuration settings
  • Usage statistics
  • AI interaction logs (for service operation and abuse prevention)
  • Conversation history (temporarily retained for context continuity)

Data is handled in accordance with the Privacy Policy.

AI Provider Data Processing: When you interact with Gander's AI features, your prompts and conversation data are processed by our third-party AI providers. Please note:

  • Google Gemini (Paid Tier): When using Google's paid API services, Google does not use your prompts or responses to improve their products or train their models. Data is processed in accordance with Google's Data Processing Addendum.
  • Amazon Bedrock: AWS does not use your inputs or outputs to train Amazon or third-party models. Your content remains within the AWS region where the service is deployed.

7. Service Modifications, Pricing, and Usage Limits

Service Modifications: The project reserves the right to modify, suspend, or discontinue Gander or any features thereof at any time with or without notice. There is no liability to you or any third party for any modification, suspension, or discontinuation.

AI Provider Changes: We reserve the right to change, add, or remove AI providers at any time without notice. This includes switching between providers such as Google Gemini, Amazon Bedrock, or other AI services. Such changes may affect response quality, speed, or capabilities.

Pricing Changes: While currently free, pricing and service terms may change at any time at our sole discretion. We reserve the right to introduce fees, subscription models, or usage limits without prior notice.

Usage Limits: We reserve the right to implement usage limits, rate limiting, or access restrictions at any time without notice to ensure fair usage and service stability.

8. Infrastructure and Data Location

Hosting Location: Gander's infrastructure is hosted on Google Cloud Platform (GCP), primarily in the US-Central1 region (United States). By using this service, you acknowledge and consent to your data being processed and stored in the United States.

International Data Transfers: If you are located outside the United States (including the UK, EEA, or Switzerland), your data will be transferred to and processed in the United States. We rely on appropriate legal mechanisms for such transfers, including Standard Contractual Clauses where required.

Third-Party Processing: AI processing may occur in various locations depending on the AI provider's infrastructure. Google and AWS maintain data processing facilities globally but process Gander's AI requests in compliance with their respective data processing agreements.

9. Termination

Access to Gander may be terminated or suspended immediately, without prior notice or liability, for any reason, including breach of these Terms and Conditions.

10. Limitation of Liability and Disclaimers

IMPORTANT DISCLAIMER: Gander is provided as a free, best-effort project without any warranty or guarantee of service availability, functionality, or data integrity.

AI-SPECIFIC DISCLAIMERS:

  • AI-generated content is provided "as-is" without any warranty of accuracy, completeness, or fitness for any purpose
  • We do not guarantee the AI will be available, functional, or produce useful outputs
  • We are not liable for any decisions, actions, or consequences arising from reliance on AI-generated content
  • We are not liable for any content generated by the AI that may be offensive, inaccurate, or harmful
  • We do not warrant that AI safety measures will prevent all inappropriate content

To the maximum extent permitted by law, the project and its developer shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from service interruptions, data loss, or technical failures
  • Any damages arising from your use or inability to use Gander
  • Any third-party actions or content related to your use of the service
  • Any AI-generated content or responses
  • Any harm caused by reliance on AI-generated content
  • Any violations of third-party rights caused by AI-generated content
  • Any damages arising from changes to or discontinuation of AI providers

AS A FREE PROJECT: This service is provided "as-is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

UK CONSUMER RIGHTS: Nothing in these terms affects your statutory rights as a consumer under UK law. However, as this is a free service with no contract for supply of goods or services for consideration, consumer protection regulations regarding quality and fitness for purpose may have limited application.

11. Indemnification

You agree to indemnify, defend, and hold harmless the project, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of Gander or its AI features
  • Content you submit to or generate through the service
  • Your violation of these terms
  • Your violation of any third-party rights
  • Your violation of AI provider terms of service

12. Changes to Terms

These Terms and Conditions may be updated from time to time. Changes will be posted on this page with an updated "last updated" date. Continued use of the service constitutes acceptance of updated terms.

14. Account Deletion and Data Removal

You may request deletion of your account and associated data at any time via Settings > Delete Account. Upon deletion:

  • Your account and authentication data will be permanently removed
  • All bot configurations and settings will be deleted
  • Associated service processes will be stopped and removed
  • Game statistics (such as quest data, TCG cards, and other gameplay records) are anonymised but retained for platform integrity and historical accuracy
  • Some aggregated, anonymised statistics may be retained for service improvement

Full Data Deletion: If you require complete deletion of all data, including anonymised game statistics, please contact us via the Support page at soulstack.gg/support. We will process full deletion requests within 30 days. This approach is consistent across all Goose Quest services.

AI Data Retention: Please note that conversation data previously processed by AI providers may be retained by those providers in accordance with their data retention policies (see Section 18). We cannot guarantee deletion of data already transmitted to third-party AI services, though such data is typically not associated with your identity.

Please note: Account deletion is irreversible. All personal data, configurations, and progress will be permanently lost.

15. Force Majeure

The project shall not be held liable for any failure or delay in service performance caused by circumstances beyond reasonable control, including but not limited to natural disasters, power failures, internet service disruptions, technical failures, strikes, war, governmental actions, or third-party service outages (including AI provider outages). In such events, reasonable efforts will be made to resume service when possible, but there is no obligation to do so within any specific timeframe.

16. Service Availability

Gander is provided on an "as and when available" basis as a free project. There are no guarantees that the service will be uninterrupted or error-free. Service availability may be subject to maintenance, upgrades, or unforeseen technical issues. No specific uptime or service reliability is promised.

NO SERVICE LEVEL AGREEMENT (SLA): We do not offer any Service Level Agreement. There are no uptime guarantees, no response time commitments, and no compensation for downtime or service degradation.

The project reserves the right to suspend, modify, or discontinue Gander at any time, without notice, and shall not be liable for any losses or issues arising from such actions.

17. UK, EEA, and Swiss Users: Additional Rights

If you are located in the United Kingdom, European Economic Area, or Switzerland, the following additional provisions apply:

Data Controller: For the purposes of UK GDPR and EU GDPR, the data controller for your personal data is the operator of this service.

Legal Basis for Processing: We process your personal data based on:

  • Contract: Processing necessary for the performance of our service to you
  • Legitimate Interests: Processing for service improvement, security, and abuse prevention
  • Consent: Where specifically obtained for optional features

Your Rights: Under data protection law, you have rights including:

  • Right of Access: Request a copy of your personal data
  • Right to Rectification: Request correction of inaccurate data
  • Right to Erasure: Request deletion of your data (subject to legal obligations)
  • Right to Restrict Processing: Request limitation of processing
  • Right to Data Portability: Receive your data in a structured format
  • Right to Object: Object to processing based on legitimate interests
  • Right to Withdraw Consent: Where processing is based on consent

International Transfers: Your data is transferred to the United States for processing. We ensure appropriate safeguards are in place, including Standard Contractual Clauses approved by the UK ICO and European Commission, where required.

Complaints: You have the right to lodge a complaint with a supervisory authority. In the UK, this is the Information Commissioner's Office (ICO) at ico.org.uk.

18. Third-Party AI Providers

Gander uses third-party AI services to provide AI-powered features. The following providers may process your data:

Data Processing: When using Google Gemini through our paid API tier:

  • Google does NOT use your prompts or responses to train their AI models
  • Your data is processed in accordance with Google's Data Processing Addendum
  • Data may be temporarily logged for abuse detection purposes only

  • AWS does NOT use your inputs or outputs to train Amazon or third-party models
  • Your content is processed within AWS infrastructure

Important Notes on AI Provider Data Practices

  • AI providers may temporarily log prompts and responses for abuse detection, safety monitoring, and legal compliance
  • Such logging is typically short-term (e.g. 30 days) and is not used for model training
  • We select AI providers that commit to NOT training on user inputs
  • AI providers maintain their own security and privacy practices independent of our control
  • We are not responsible for AI provider practices, though we endeavour to select providers with strong privacy commitments

19. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Alternative Dispute Resolution: We encourage resolution of any disputes through informal discussion first. Please contact us via the Support page at soulstack.gg/support before initiating any formal proceedings.

20. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and the project regarding your use of Gander and supersede any prior agreements.
